Terms and Conditions

1. Scope

The following terms and conditions apply to all orders placed through our online shop. Our online shop is directed exclusively at consumers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade, business or profession.

2. Contracting party, conclusion of the contract, correction of entries

The purchase contract is concluded with Ipanema Beauty UG (haftungsbeschränkt), Pappelallee 78/79, 10437 Berlin, Germany.

By presenting the products in the online shop we make a binding offer to conclude a contract for those items. You can first place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order, using the correction tools provided and explained during the ordering process. The contract is concluded when you accept the offer for the goods in the shopping cart by clicking the order button. Immediately after you submit the order you will receive a confirmation by e-mail.

3. Contract language, storage of the contract text

The contract can be concluded in English, German, Danish, Finnish, French, Italian, Norwegian, Polish, Portuguese, Spanish and Swedish.

We store the contract text and send you the order data together with these terms and conditions in text form. You can also view the contract text in your customer account.

4. Delivery, shipping costs and taxes

We deliver to Austria, Belgium, Bulgaria, Croatia, Cyprus, Czechia, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Norway, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland and the United Kingdom.

Shipping costs may be charged in addition to the stated product prices. You will find the details on our shipping page and during the ordering process. The shipping cost applicable to your order is shown before you submit the order.

For deliveries within the European Union, all prices include the statutory value added tax of the country of delivery. For deliveries to Switzerland, Norway and the United Kingdom, our prices do not include import duties, import value added tax or the carrier's customs handling fees. Where such charges arise, they are payable by you on delivery.

We deliver by carrier only. Collection in person is not possible.

5. Payment

The following payment methods are generally available in our shop. Which methods are offered in an individual case is shown during the ordering process.

Credit and debit card

When you submit the order you provide your card details. Once you have been identified as the legitimate cardholder, the payment transaction is carried out automatically and your card is charged. Processing is handled by Shopify Payments.

Apple Pay, Google Pay and Shop Pay

To pay with Apple Pay, Google Pay or Shop Pay you must be registered with the relevant provider, have activated the function, identify yourself with your access data and confirm the payment instruction. The payment transaction is carried out immediately after you submit the order. Processing is handled by Shopify Payments.

PayPal

During the ordering process you are redirected to the PayPal website. To pay the invoice amount through PayPal you must be registered there or register first, identify yourself with your access data and confirm the payment instruction to us. After you submit the order we ask PayPal to initiate the payment transaction.

iDEAL and Bancontact

iDEAL and Bancontact payments are processed by Mollie B.V., Keizersgracht 126, 1015 CW Amsterdam, Netherlands. During the ordering process you are redirected to your bank, where you confirm the payment. The amount is debited from your account immediately afterwards.

Klarna

Klarna's payment methods, in particular pay later and instalment payments, are arranged through Mollie B.V., Keizersgracht 126, 1015 CW Amsterdam, Netherlands, with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden. Payment is made to Klarna in each case. For pay later and instalment payments Klarna carries out an identity and credit check. 6. Retention of title

The goods remain our property until payment has been made in full.

7. Right of withdrawal

Consumers have a statutory right of withdrawal. We voluntarily grant you a withdrawal period of thirty days, which is longer than the statutory period of fourteen days. Please see our withdrawal policy for the details, which also contains the model withdrawal form.

8. Transport damage

If goods are delivered with obvious transport damage, please report the damage to the carrier as soon as possible and contact us without delay. Failing to make such a report or to contact us has no consequences whatsoever for your statutory claims and their enforcement, in particular your warranty rights. It does, however, help us to pursue our own claims against the carrier or the transport insurer.

9. Warranty and guarantees

The statutory rules on liability for defects apply.

Information on any additional guarantees that may apply and their precise conditions can be found with the individual product and on dedicated information pages in the online shop.

10. Liability

For claims based on damage caused by us, our legal representatives or our vicarious agents, we are always liable without limitation

  • for injury to life, body or health,
  • for intentional or grossly negligent breach of duty,
  • under guarantee promises, where agreed,
  • to the extent that the Product Liability Act applies.

In the event of a slightly negligent breach by us, our legal representatives or our vicarious agents of material contractual obligations, meaning obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the contracting party may regularly rely, liability is limited in amount to the damage foreseeable at the time the contract was concluded and typical for this type of contract.

Any further claims for damages are excluded.

11. Applicable law

The law of the Federal Republic of Germany applies, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods. This choice of law does not deprive you of the protection afforded to you by provisions that cannot be derogated from by agreement under the law of the country in which you have your habitual residence.

12. Dispute resolution

We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
